DISTRICT FINANCIAL OVERSIGHT

The County Office of Education has fiscal oversight over the districts within the county, as well as some charter schools. The county superintendent must review-and approve or disapprove-each district's annual budget and two interim financial reports. The county superintendent is responsible for providing management assistance, as well as support and intervention, to ensure that districts are fiscally viable; as well as taking specific actions if a district may not be able to meet its financial obligations.

Additionally, the county superintendent has authority under the following legislation:

  • AB139 permits the review or audit of any school district or charter in the county if there is reason to believe that fraud, misappropriation of funds or other illegal practices have occurred.
  • AB2756 grants the authority to certify that the costs of collective bargaining can be met.
  • AB2197 permits counsel to boards as to whether debt instruments are affordable.
